Um, Tell me if I'm missing something here. Are we saying her mom took a picture of her topless or her mom took a picture of her daughter's phone screen which had a picture of her duaghter topless on it? If the latter, am I the only one who is going to ask why a topless picture of her exists in the first place? That part just seems to be glossed right over. I can't imagine anybody taking nude or semi-nude pictures of themself just for their own personal viewing and that's it, but maybe I'm dumb.
She took a photo of her daughter's phone with the picture on it, then uploaded it to social media. As far as teenagers having nudes of themselves I'm sure they probably all do it.

I see that as a major problem. Imagine if you have a teenager who is brought up on possession of child pornography charges because “they’re all doing it.” Are we also going to go after the kids who took and sent the pictures or are we just going to assume they’re all victims of a pressuring predator?

Imagine if you have a teenager who is brought up on possession of child pornography charges because “they’re all doing it.” Are we also going to go after the kids who took and sent the pictures or are we just going to assume they’re all victims of a pressuring predator?
This is dated so it's likely more now but it gives the idea.

Plenty of people are sexting and sharing nudes. Didn't Jennifer Lawrence's nudes get hacked and leaked?

I would assume so. Still illegal. I feel like in a way we're burying the lead in favor of the low hanging fruit.

So is drinking under age and taking drugs. If her sexual partners are her own age who cares? Personally I favour codifying half age plus 7 up to 21.

I think a better comparison is drunk driving. If the picture stays between them, then fine (I guess?). If it gets out then there is a big domino effect of far reaching consequences, for them and beyond. I'm no prude, but this country, and possibly society, is way too eager to slap "pedophile!" and lifetime registered sex offender on even the thinnest of circumstances. I was sexually active in high school (late 80's/early 90's) and as I look back now I feel damn lucky I didn't piss off any of those partners or their parents.

America’s desire to criminalise everything is highly counter-productive.

If sexual photos are shared by a trusted person more widely that is sexual harassment and can (and should) be charged under those laws. Hell maybe the phone people should handle intimate photos separately somehow.

I think we should revisit those laws given the new technology and ease of use. Let's say she shares that photo with just her boyfriend/girlfriend and they share it with their "close" friends. Hell, I shared stories about my exploits with my friends when I was younger, thank God we didn't have cell phones back then. We are talking about not fully developed adults yet living in a world where a sex tape can actually make them more successful, or kill themself. Where do we draw the line and start dropping the prosecution hammer?

And I also don't think it's fair to assume the photo taker is always the victim in this, not saying the photo receiver is either, but I'm sure there are plenty of photos sent out there that are sent to keep the receiver's interest of pull them in.

I have an uncle who actually went to big boy prison San Quintin for getting so many DUIs in the 70's and 80's, most of which were slap on the wrists from law enforcement, "We'll just give you a ride/follow you home." The good old days.

You wouldn’t believe the number of students I had both in high school and even middle school (!) who already had sex offender status because of sharing nude selfies. They just don’t think. And they definitely don’t think that the boyfriend or girlfriend they send that photo to today may not be the love of their life tomorrow. Or that by sharing it they are guilty of child pornography because....they are children!
