AP is reporting that the appeals court in DC has declined to order dismissal of charges against Trump's former national security advisor, Michael Flynn. Means the judge can examine circumstances behind the DoJ's request to drop the Flynn case altogether.

So the power struggle continues between the courts and the Trump administration on this matter, which has become a mini "case" unto itself, starring US District Judge Emmet Sullivan v US Attorney General Willliam Barr.

Hell yeah. This has been hanging fire since last June. The reason Barr's so alarmed about it is that Sullivan had sensibly enough taken a step back from direct involvement and had appointed a former federal judge now in private practice to take a look at the DoJ's request to dismiss the case.

Then in June that former judge, John Gleeson, a guy with 20 years on the federal bench and previous federal prosecutorial experience, actually used the phrase "gross abuse of power" when summarizing his opinion of the DoJ's move to throw Flynn's case out. He also wrote that the US government “has engaged in highly irregular conduct to benefit a political ally of the President.” And argued that he Gleeson thought Flynn had committed perjury.

So no wonder the DoJ went back trying once again to press Sullivan to just dismiss the case already, trying to argue the move to have Gleeson examine the DoJ's request was itself improper. Barr's like the Duracell Bunny. Not out of juice yet, either, even if the most recent ruling was a flop in court.

You’d think as big as he is, he would have run out of juice a long time ago.

I’m looking forward to him going even more than Donald. Hopefully he will also be disbarred.

The Republicans who are now attacking Trump are being called traitors by their base. We can only hope sane> Trumpettes (whether volunteer or they feel like they were forced but now he is their only political game in town).

A lot of this stuff is not going to matter in the least depending on how covid-19 wends its merry way through the USA with or without adequate further stimulus of the economy (a thing distinctly not the same as the stock market).

This probably why some pro-Trump Rs are getting so loud in advance of early voting. They want those ballots popped in for Trump while the markets may still look good and back rents deferred haven't quite turned into eviction notices.

My concern is that both sides in Congress want to have their political cake and serve up something to save their behinds in November as well. They are playing a dangerous game and yet it's long since been time for the Dems to show the Republicans almost what it feels like to be on the other side of a situation where the other side flat out refuses to compromise. The Dems need to give an inch in the end, and soon, but not let the people get taken for the damn mile and a half down the road once again. Trump's idea to deferring the payroll tax is nothing but a foot in the door to completely privatizing retirement benefits.
