I saw there is an interesting legal point on this matter. The cases are being dismissed "without prejudice", which means that the judge is not issuing a ruling but saying "bring me some evidence next time you try this". The important point is that the dismissal is not a ruling, so it cannot be appealed. They cannot take it to the SCotUS if they cannot even get it into the court system and get a ruling to begin with. And at some point a judge will say, "I will fine you/lock you up for contempt if you keep bringing me this garbage."
